๐️ Case Drama in Abuja! Man Loses Case, Ordered to Pay ₦5 Million to DSS Over False Human Rights Claim
A High Court in Abuja has ordered a man, Sunday Dominic, to pay ₦5 million in damages to the Department of State Services (DSS) after dismissing his human rights suit as frivolous and baseless.
Justice A. Y. Shafa, who delivered the ruling, said Dominic failed to prove that his fundamental human rights were violated by the security agency. The court described the lawsuit as “a waste of judicial time” and warned against using the courts to harass government institutions without evidence.
The case, filed under FCT/HC/CV/3984/2024, began when Sunday Dominic accused the DSS of threatening to arrest him after being invited for questioning over an alleged fraud. He claimed that the agency’s actions violated his rights to life, dignity, and personal liberty.
However, during the hearing, the DSS argued that the invitation was part of an ongoing investigation and did not amount to harassment or abuse of rights. The court agreed, noting that no concrete evidence of rights violation was presented.
Justice Shafa ruled that the DSS acted within its lawful powers and that the applicant’s claims were unsubstantiated.
“The court cannot be used as a shield for suspects who seek to frustrate lawful investigations. This application lacks merit and is accordingly dismissed,” the judge said.
The court further ordered the applicant to pay ₦5 million to the DSS as compensation for filing a frivolous human rights case.
The ruling has sparked mixed reactions among Nigerians. While some praised the court for discouraging abuse of human rights litigation, others argued that the fine was too steep and could discourage genuine victims from seeking justice.
Legal analysts, however, say the judgment sends a clear message — human rights laws should not be exploited for personal gain or to obstruct lawful investigations.
